Protection of personal data

 

This Privacy Notice provides a framework for understanding the personal data, which are collected by the data controller (as defined below), as required by law, including the provisions of the general data protection regulation of the European union (hereinafter “GDPR”). Personal data will be controlled and processed by the Operator of the data in accordance with the terms of this notice on personal data protection.

The operator

This Privacy Notice applies to (1) persons who we are helping with the search for employment and recipients of our services, (2) our temporarily assigned employees, who temporarily assign to the performance of work to a different user employers (clients) and suppliers (natural persons), who we use to fulfill the orders placed for our clients, (3) website users www.grain.sk, (4) the representatives of our business partners, clients and suppliers, (5) the person whose personal data we use to our marketing activities and (6) the persons, who are recommended to us by the person of the potential candidates, who are interested in recruitment.

Privacy Notice describes the types of personal data or the personal data we collect, how we use data, how we treat and protect collected data, how long we store it, with whom we may share it, to whom we transfer it and the rights individuals may perform in connection with the use of their personal data. Privacy Notice describes, how you can learn more about the protection of personal data at Grain Slovakia s.r.o. and to exercise its rights.

 

The personal data that we collect

Depending on the nature of the relationship with you we shall be entitled to collect selected personal data relating to:

  • your contact information (such as name, postal address, e-mail and telephone contact);
  • additional information that you may provide us with, e.g. during surveys, or through the “Contact us” on our website.

If you are a job seeker, you respond to a job offer or otherwise apply for a job, we may collect the following categories of personal data:

  • the history of employment and history of received training;
  • the level of foreign languages competence and other skills associated with the work;
  • ID number;
  • date of birth;
  • sex;
  • bank account information;
  • citizenship and the status of the work permit;
  • information relating to taxes;
  • the information provided by the reference entity (provided by third parties as a reference);
  • the information contained in your CV or motivation letter
  • the information you provide about your career interests, and other information about your skills and qualifications for the job;
  • information regarding your employment in our company or in our client;

In addition, we may collect data that you provide us about other individuals, such as information about a contact in case of urgent situation. .

 

How we use the collected personal data

The operator collects personal data for the following purposes: :

  1. recruitment and provision of solutions related to the labor force and the involvement of people into work;
  2. the processing of payments;
  3. managing of our relationships with clients, business partners;
  4. sending of promotional materials, job vacancy notifications, and other notifications in accordance with Cookie Notice and the Operator advertisement notice about data cookies and advertising
  5. information about special events, programs, offers and provision of participation in them;
  6. reply to questions and requests
  7. operation, evaluation and improvement of our business (including development, improvement, analysis and improvement of our services, management of our communication, data analysis and performing of accounting, auditing and other internal functions);
  8. protection, identification and efforts to prevent fraud and other illegal activity;

All processing activities will be carried out on the basis of the corresponding legal grounds, which includes the following:

  1. your consent or explicit consent of the data subject, if it is required by valid legal regulations (e.g. the processing of your personal data for the continuous brokering of employment);
  2. ensure that we fulfill the obligations which are determined by our legislation. In these cases, the provision of your personal data is the requirement of legislation and there is an obligation to provide such personal data.
  3. ensuring that we meet the contractual obligations we have with you, or that we take the necessary measures before the contract is concluded. In these cases, the provision of your personal data is an essential requirement of the contract.
  4. It is the necessity for the legitimate interest of the Operator

If you are a job seeker and you are applying for a position, we use your personal data as described above for the following purposes:

  1. to ensure you get job opportunities and work;
  2. to provide you with human resources services;
  3. to provide additional services such as training, career counseling and career change services;
  4. to assess your suitability as a candidate for a job and assess your qualifications for the position;
  5. and perform data analysis ;

If we want to us these information in other ways, we will inform you in advance.

 

The lawfulness of the processing

The operator may process your personal data to certain authorized business purpose, which may be:

  • improving our services and communicating for the benefit of our clients, job seekers and temporarily assigned employees;
  • identifying and preventing fraud;
  • a better understanding of how people interact with our website;
  • sending communications messages and notifications that we think you might be interested in;
  • the exercising of our rights towards you or our clients and business partners;
  • the fulfilment of the contractual obligations towards our clients or business partners.

How we process and protect personal data

The personal data that we collect we process for the purposes defined in this notice and for a period of time, which is necessary only for the purposes for which we have collected it. Different laws may also require the obligation to store different data for different periods of time.

We comply with administrative, technical and physical security measures designed to protect your personal data against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. In order to ensure the adequate security and confidentiality of personal data, we apply the following security measures:

  • technical security systems;
  • the physical security of the environment;
  • encryption of data in transit;
  • protection against access by unauthorized persons;

How long we store collected personal data

In our systems, we keep the collected personal data in a way that makes it possible to identify the data subject not for a longer period of time than is necessary for the purposes for which the data were collected or for which the data are further processed.

We will determine this specific period, taking into account:

  • the necessity to store the collected personal data in order to offer and provide you the required services;
  • in order to protect the lawfulness of the processing of the Operator, as is described in the following purposes;
  • the existence of specific legal or contractual obligations and liabilities

 

Sharing of personal data

We do not make public the personal data that we collect about you, except in cases which are referred to in this privacy Notice or in separate notices provided in connection with specific activities. We may also share your personal data if you are job seeker with clients who may have available job opportunities or are interested in placing our job seekers, or with other persons, with whom we are working, such as external consultants, translators, in order to find you a job or help you to ensure entry to the labor market; and with others, with whom we are working with legal and tax advisors and specialists if it is necessary to meet our legal obligations.

 

Transfers of personal data to other countries

We may also transfer the personal data that we collect about you to countries different from the country in which your personal data were originally collected. These countries may not have the same laws on data protection as the country in which you originally provided the personal data. We will help protect your personal data, in the case of its transmission to other countries, as described in this Privacy Notice of GDPR, and such transfers will be in accordance with the applicable legislation.

 

Your rights and options as a data subject

If it is possible by applicable law, the data subject may, pursuant to articles 15 to 22 of the GDPR to invoke these specific rights:

  1. Right of access: the data Subject has the right to access his/her personal data to verify whether the personal data are processed in accordance with the law.
  2. Right of rectification: the data Subject has the right to request the correction of any inaccurate or incomplete data concerning her/him to protect the accuracy of such information and adapt them to processing of data.
  3. The right to erasure: the data Subject has right to request the data controller to erase personal data concerning him or her and not to process such data anymore.
  4. Right to restriction of processing: the data Subject has the right to require the data controller to process his/her data to a limited extent. .
  5. Right to data portability: the data has the right to require transfer of data, which means that the data Subject may accept originally provided personal data in a structured and commonly used format
  6. Right to object: the data Subject, who provides the data controller his/her personal data shall have the right to object at any time to processing data for number of reasons set out in the GDPR, without having to justify his/her decision.
  7. Right not to be subject to automated decision-making: the data Subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.
  8. Right to lodge a complaint with a supervisory authority: Every data subject shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes GDPR.

When the processing is based on consent, as it is in article 7 of regulation GDPR, the data subject has shall the right to withdraw his or her consent at any time.
